(وَ) لَوْ وَصَّى (بِعِتْقِ عَبْدٍ) مِنْ عَبِيدِهِ (بِأَلْفٍ) نَفَذَ ذَلِكَ إنْ خَرَجَ الْأَلْفُ مِنْ الثُّلُثِ، أَوْ (اُشْتُرِيَ) عَبْدٌ (بِثُلُثِهِ) ؛ أَيْ: ثُلُثِ الْمَالِ (إنْ لَمْ يَخْرُجْ) الْأَلْفُ مِنْ الثُّلُثِ، وَلَمْ تُجِزْ الْوَرَثَةُ.
