(يُعْتَبَرُ) فِي الْمُوصَى بِهِ (إمْكَانُهُ) قَالَهُ فِي " الْفُرُوعِ " (فَلَا) تَصِحُّ الْوَصِيَّةُ (بِمُدَبَّرٍ) لِعَدَمِ إمْكَانِهِ بِحُرِّيَّتِهِ بِمَوْتِ الْمُوصِي، وَلَا بِحَمْلِ أَمَتِهِ الْآيِسَةِ، وَلَا بِخِدْمَةِ أَمَتِهِ الزَّمِنَةِ.
