وَوَلَدُهَا مِنْ شُبْهَةٍ حُرٍّ، وَلِلْوَرَثَةِ قِيمَتُهُ عِنْدَ وَضْعٍ عَلَى وَاطِيءٍ

(فَوَلَدُهَا مِنْ) وَطْءِ (شُبْهَةِ حُرٍّ) لِاعْتِقَادِ الْوَاطِئِ أَنَّهُ وَطِئَ فِي مِلْكٍ كَالْمَغْرُورِ بِأَمَةٍ (وَلِلْوَرَثَةِ قِيمَتُهُ) ؛ أَيْ: الْوَلَدِ (عِنْدَ وَضْعٍ عَلَى وَاطِئٍ) لِأَنَّهُ فَوَّتَ رِقَّهُ عَلَيْهِمْ بِاعْتِقَادِهِ حُرِّيَّتَهُ، وَاعْتُبِرَتْ حَالَةُ الْوَضْعِ؛ لِأَنَّهُ أَوَّلُ إمْكَانِ تَقْوِيمِهِ
