(وَوَلَدُهَا مِنْ زَوْجٍ) لَمْ يُشْتَرَطْ حُرِّيَّتُهُ (أَوْ) مِنْ (زِنًا لَهُ) ؛ أَيْ: لِمَالِكِ الرَّقَبَةِ؛ لِأَنَّ الْوَلَدَ جُزْءٌ مِنْهَا، وَلَيْسَ مِنْ النَّفْعِ الْمُوصَى بِهِ، وَلَا هُوَ مِنْ الرَّقَبَةِ الْمُوصَى بِنَفْعِهَا، فَكَانَ لِمَالِكِ الرَّقَبَةِ
