مطالب أولي النهىal-Ruhaybani

(وَ) الْحَادِيَ عَشَرَ: (سُنَّةُ طَلَاقٍ) ، لِأَنَّهُ فِي الْحَيْضِ بِدْعَةٌ مُحَرَّمَةٌ، كَمَا يَأْتِي مُوَضَّحًا فِي بَابِهِ، (مَا لَمْ تَسْأَلْهُ) - أَيْ: الْحَائِضُ - (خُلْعًا أَوْ طَلَاقًا) فَيُبَاحُ لَهُ إجَابَتُهَا، لِأَنَّ الْمَنْعَ لِتَضَرُّرِهَا بِطُولِ الْعِدَّةِ، وَمَعَ سُؤَالِهَا قَدْ أَدْخَلَتْ الضَّرَرَ عَلَى نَفْسِهَا.
