وَلَا نَظَرَ لِحَاكِم مَعَ وَصِيٍّ خَاصٍّ كُفُؤٍ

(وَلَا نَظَرَ لِحَاكِمٍ مَعَ وَصِيٍّ خَاصٍّ كُفُؤٍ فِي ذَلِكَ التَّصَرُّفِ الَّذِي أُسْنِدَ إلَيْهِ) ؛ لِأَنَّ الْوَصِيَّةَ تَقْطَعُ نَظَرَ الْحَاكِمِ، لَكِنْ لَهُ الِاعْتِرَاضُ عَلَيْهِ إنْ فَعَلَ مَا لَا يَسُوغُ عَلَى مَا تَقَدَّمَ فِي نَاظِرِ الْوَقْفِ.
