وَالْوُرَّاثُ ثَلَاثَةٌ: ذُو فَرْضٍ، وَعَصَبٍ، وَرَحِمٍ.

(وَالْوَارِثُ ثَلَاثَةُ) أَصْنَافٍ: (ذُو فَرْضٍ) ؛ أَيْ: نَصِيبٍ (وَعَصَبَةٍ) يَرِثُونَ بِلَا تَقْدِيرٍ (وَ) ذُو (رَحِمٍ) يَرِثُونَ عِنْدَ عَدَمِ الْعَصَبَاتِ، وَأَصْحَابُ الْفُرُوضِ غَيْرُ الزَّوْجَيْنِ.
