(وَإِلَّا) يَشْهَدْ بِهِ عَدْلَانِ مَعَ إقْرَارِ بَعْضِ الْوَرَثَةِ بِهِ (ثَبَتَ نَسَبُهُ) ؛ أَيْ: الْمُقَرِّ بِهِ (مِنْ مُقِرٍّ وَارِثٍ فَقَطْ) ؛ لِأَنَّهُ إقْرَارٌ عَلَى نَفْسِهِ خَاصَّةً فَلَزِمَهُ كَسَائِرِ الْحُقُوقِ، وَلَمْ يَثْبُتْ نَسَبُهُ الْمُطْلَقُ؛ لِأَنَّهُ إقْرَارٌ عَلَى الْغَيْرِ؛ فَلَمْ يُعْمَلْ بِهِ
