[فَصْلٌ يُرَدُّ عَلَى كُلِّ ذِي فَرْضٍ بَعْضُهُ حُرٌّ] (فَصْلٌ: وَيُرَدُّ عَلَى) كُلِّ

(ذِي فَرْضٍ) بَعْضُهُ حُرٌّ (وَ) يُرَدُّ أَيْضًا عَلَى كُلِّ (عَصَبَةٍ) بَعْضُهُ حُرٌّ (إنْ لَمْ يُصِبْهُ) مِنْ التَّرِكَةِ (بِقَدْرِ حُرِّيَّتِهِ مِنْ نَفْسِهِ، لَكِنْ أَيُّهُمَا) ؛ أَيْ: الْعَصَبَةُ أَوْ ذَوُو الْفَرْضِ
