(وَيَتَّجِهُ) أَنَّ الْحَاكِمَ يُزَوِّجُ أَمَةَ مَنْ عُذِرَ بِشَيْءٍ مِمَّا ذُكِرَ (إنْ كَانَ لَا وَلِيَّ لَهَا) أَيْ: الْأَمَةِ (غَيْرُهُ) أَيْ: غَيْرُ سَيِّدِهَا الْمَعْذُورِ،

أَمَّا إذَا كَانَتْ مُشْتَرَكَةً، وَاضْطُرَّتْ لِلْفِرَاشِ؛ فَلِلْحَاضِرِ تَزْوِيجُهَا كَالْحُرَّةِ يُزَوِّجُهَا الْأَبْعَدُ عِنْدَ تَعَذُّرِ الْأَقْرَبِ وَهُوَ مُتَّجِهٌ.
