(وَيَحْرُمُ) عَلَى وَلِيِّ الْمَرْأَةِ (تَزْوِيجُهَا بِغَيْرِ كُفْءٍ بِلَا رِضَاهَا) لِأَنَّهُ إضْرَارٌ بِهَا، وَإِدْخَالٌ لِلْعَارِ عَلَيْهَا (وَيَفْسُقُ بِهِ) أَيْ: بِتَزْوِيجِهَا (وَلِيٌّ) بِغَيْرٍ كُفْءٍ بِلَا رِضَاهَا إنْ تَعَمَّدَ.
