(وَكِتَابِيٌّ حُرٌّ فِي ذَلِكَ) أَيْ: فِي تَزَوُّجِ الْأَمَةِ (كَمُسْلِمٍ) فَلَا تَحِلُّ لَهُ إلَّا بِالشَّرْطَيْنِ، وَكَوْنُهَا كِتَابِيَّةً.
