(وَمَنْ شَرَطَ) لِزَوْجَتِهِ (أَنْ لَا يُخْرِجَهَا مِنْ مَنْزِلِ أَبَوَيْهَا فَمَاتَ أَحَدُهُمَا) أَيْ: أَحَدُ أَبَوَيْهَا (بَطَلَ الشَّرْطُ) لِأَنَّ الْمَنْزِلَ صَارَ لِأَحَدِهِمَا بَعْدَ أَنْ كَانَ لَهُمَا، فَاسْتَحَالَ إخْرَاجُهَا مِنْ مَنْزِلِ أَبَوَيْهَا فَبَطَلَ الشَّرْطُ.
