وَهُوَ مُتَّجِهٌ: (وَإِنْ شَرَطَ) فِي الزَّوْجَةِ (صِفَةً أَدْنَى فَبَانَتْ) صِفَتُهَا (أَعْلَى) مِنْ الصِّفَةِ الَّتِي شَرَطَهَا، كَأَنْ شَرَطَهَا (كِتَابِيَّةً، أَوْ) شَرَطَهَا (أَمَةً فَبَانَتْ مُسْلِمَةً أَوْ حُرَّةً؛ فَلَا خِيَارَ لَهُ) ؛ لِأَنَّهُ زِيَادَةُ خَيْرٍ فِيهَا.
