مطالب أولي النهىal-Ruhaybani

(إلَّا مَعَ جَبِّهِ) أَيْ: الزَّوْجِ (وَرَتْقِهَا) أَيْ: الزَّوْجَةِ (فَلَا يَنْبَغِي) لِأَحَدِهِمَا (ثُبُوتُ خِيَارٍ قَالَهُ الْمُوَفَّقُ) وَالشَّارِحُ وَصَاحِبُ " الْمُبْدِعِ "؛ لِأَنَّ عَيْبَهُ لَيْسَ هُوَ الْمَانِعَ لِصَاحِبِهِ مِنْ الِاسْتِمْتَاعِ، وَإِنَّمَا امْتَنَعَ لِعَيْبِ نَفْسِهِ.
