(وَمَنْ فَسَخَ) مِنْهُمَا النِّكَاحَ (لِعَيْبٍ) كَأَنْ رَأَى أَحَدُهُمَا بِبَدَنِ الْآخَرِ بَيَاضًا فَظَنَّهُ بَرَصًا (فَبَانَ عَدَمُهُ) أَيْ: الْعَيْبِ (فَالنِّكَاحُ بَاقٍ بِحَالِهِ) وَالْفَسْخُ بَاطِلٌ، إذْ الْحُكْمُ يَدُورُ مَعَ عِلَّتِهِ وُجُودًا وَعَدَمًا.
