(فَإِنْ أَتَوْنَا) أَيْ: الْكُفَّارُ (قَبْلَ عَقْدِهِ) أَيْ: النِّكَاحِ بَيْنَهُمْ (عَقَدْنَاهُ عَلَى حُكْمِنَا) بِإِيجَابٍ وَقَبُولٍ وَوَلِيٍّ وَشَاهِدَيْ عَدْلٍ مِنَّا، كَأَنْكِحَةِ الْمُسْلِمِينَ؛ لِقَوْلِهِ تَعَالَى:{وَإِنْ حَكَمْتَ فَاحْكُمْ بَيْنَهُمْ بِالْقِسْطِ} وَلِأَنَّهُ لَا حَاجَةَ إلَى عَقْدٍ يُخَالِفُ ذَلِكَ
