(وَإِنْ عَلِمَ الْمَدْعُوُّ بِهِ) أَيْ: بِالْمُنْكَرِ (وَلَمْ يَرَهُ، وَلَمْ يَسْمَعْهُ؛ أُبِيحَ لَهُ الْجُلُوسُ) وَالْأَكْلُ نَصًّا؛ لِأَنَّ الْمُحَرَّمَ رُؤْيَةُ الْمُنْكَرِ وَسَمَاعُهُ، وَلَمْ يُوجَدْ، وَأُبِيحَ لَهُ الِانْصِرَافُ لِإِسْقَاطِ حُرْمَةِ نَفْسِهِ بِإِيجَادِ الْمُنْكَرِ.
