(وَلَا يَمْلِكُهُ) أَيْ: الطَّعَامُ (مِنْ قُدِّمَ إلَيْهِ) بِتَقْدِيمِهِ لَهُ (بَلْ يَهْلِكُ) الطَّعَامُ بِالْأَكْلِ (عَلَى مِلْكِ صَاحِبِهِ؛ لِأَنَّهُ لَمْ يَمْلِكْ شَيْئًا) ، وَإِنَّمَا أَبَاحَهُ الْأَكْلُ؛ فَلَا يَمْلِكُ التَّصَرُّفَ فِيهِ بِغَيْرِ إذْنِهِ.
