(إلَّا مَعَ مَحَبَّتِهِ لَهَا فَيُسَنُّ صَبْرُهَا) عَلَيْهِ (وَعَدَمُ افْتِدَائِهَا) مِنْهُ دَفْعًا لِضَرَرِهِ، وَلَا تَفْتَقِرُ صِحَّةُ الْخُلْعِ إلَى حُكْمِ حَاكِمٍ نَصًّا.
