(وَيُبَاحُ ذَلِكَ) أَيْ: عَضْلُ الزَّوْجِ لَهَا لِتَفْتَدِيَ مِنْهُ (مَعَ زِنَاهَا) نَصًّا، وَالْخُلْعُ صَحِيحٌ؛ لِقَوْلِهِ تَعَالَى:{إِلا أَنْ يَأْتِينَ بِفَاحِشَةٍ مُبَيِّنَةٍ} وَالِاسْتِثْنَاءُ مِنْ النَّهْيِ إبَاحَةٌ، وَلِأَنَّهُ لَا يَأْمَنُ أَنْ تُلْحِقَ بِهِ وَلَدًا مِنْ غَيْرِهِ.
