(وَلَا يَبْطُلُ إبْرَاءُ مَنْ) خَالَعَتْ زَوْجَهَا عَلَى بَرَاءَتِهَا لَهُ ثُمَّ (ادَّعَتْ نَحْوَ سَفَهٍ حَالَتَهُ) أَيْ: الْخُلْعَ (بِلَا بَيِّنَةٍ) تَشْهَدُ بِسَفَهِهَا أَوْ جُنُونِهَا حَالَتَهُ؛ لِأَنَّهَا تَدَّعِي الْفَسَادَ، وَالْأَصْلُ الصِّحَّةُ.
