مطالب أولي النهىal-Ruhaybani

(وَإِنْ خَالَعَهَا) فِي مَرَضِ مَوْتِهِ الْمَخُوفِ (وَحَابَاهَا) بِأَنْ أَخَذَ مِنْهَا دُونَ مَا أَعْطَاهَا أَوْ دُونَ مَا يُمْكِنُهُ الْأَخْذُ مِنْهَا بِبَذْلِهَا لَهُ (فَمِنْ رَأْسِ الْمَالِ) أَيْ: لَا يَحْتَسِبُ مَا حَابَاهَا بِهِ مِنْ الثُّلُثِ؛ لِأَنَّهُ لَوْ طَلَّقَهَا بِلَا عِوَضٍ صَحَّ؛ فَمَعَهُ أَوْلَى.
