(وَيَصِحُّ عِتْقٌ فِي شِرَاءٍ فَاسِدٍ) أَيْ: مُخْتَلَفٍ فِيهِ؛ فَيَنْفُذُ، وَيَضْمَنُهُ مُعْتِقُهُ بِقِيمَتِهِ يَوْمَ عِتْقٍ مَعَ ضَمَانِ نَقْصِهِ وَأُجْرَتِهِ إلَى حِينِ الْعِتْقِ.
