(وَإِنْ قَالَ) حَاكِمٌ (فَرَّقْتُ بَيْنَكُمَا) وَلَمْ يَنْوِ طَلَاقًا (فَهُوَ فَسْخٌ) لَا يَنْقُصُ بِهِ عَدَدُ الطَّلَاقِ؛ لِأَنَّهَا فُرْقَةٌ لَيْسَتْ بِلَفْظِ الطَّلَاقِ وَلَا نِيَّتِهِ، أَشْبَهَ قَوْلَهُ: فَسَخْت النِّكَاحَ.
