مطالب أولي النهىal-Ruhaybani

(وَإِنْ مَاتَ أَحَدُهُمَا) أَيْ: الزَّوْجَيْنِ بَعْدَ ظِهَارٍ قَبْلَ وَطْءٍ؛ سَقَطَتْ كَفَّارَةُ الظِّهَارِ، سَوَاءٌ مَاتَ عَقِبَ ظِهَارِهِ أَوْ تَرَاخَى عَنْهُ؛ لِأَنَّهُ لَمْ يُوجَدْ الْحِنْثُ، وَيَرِثُهَا وَتَرِثُهُ كَمَا بَعْدَ التَّكْفِيرِ.
