(وَيَتَّجِهُ صِحَّتُهَا) أَيْ النِّيَّةِ (هُنَا) أَيْ: فِي الْكَفَّارَةِ فَقَطْ (مِنْ كَافِرٍ) وَإِنْ كَانَ لَيْسَ مِنْ أَهْلِ النِّيَّةِ؛ لِتَوَقُّفِ الْإِجْزَاءِ عَلَيْهَا،

فَلَوْ لَمْ نُصَحِّحْهَا مِنْهُ لَمَا وَجَبَ عَلَيْهِ إخْرَاجُ الْكَفَّارَةِ وَقَدْ أَمَرَ الشَّارِعُ بِإِخْرَاجِهَا، وَهُوَ مُتَّجِهٌ
