(وَتَنْتَقِلُ) حَضَانَةٌ (مَعَ امْتِنَاعِ مُسْتَحِقِّهَا أَوْ مَعَ عَدَمِ أَهْلِيَّةٍ) ، لَهَا كَالرَّقِيقِ (إلَى مَنْ بَعْدَهُ) أَيْ: يَلِيه كَوِلَايَةِ النِّكَاحِ؛ لِأَنَّ وُجُودَ الْمُمْتَنِعِ وَغَيْرِ الْمُسْتَحِقِّ كَعَدَمِهِ
