(لَكِنْ إنْ أَوْجَبَ الْجُرْحُ قِصَاصًا اُسْتُوْفِيَ) ؛ أَيْ: اسْتَوْفَاهُ، وَلِيُّهُ مِنْ جَارِحِهِ إنْ شَاءَ؛ لِأَنَّ عَمْدَهُ يُوجِبُ الْقَوَدَ، فَيُخَيَّرُ بَيْنَهُ، وَبَيْنَ أَخْذِ أَرْشِهِ (وَإِلَّا) يُوجِبْ الْجُرْحُ قِصَاصًا (أَخَذَ) الْوَارِثُ (أَرْشَهُ) إنْ شَاءَ؛ لِأَنَّ الْحَقَّ فِيهِ لَهُ دُونَ غَيْرِهِ.
