(ثَانِيهَا) أَيْ: الشُّرُوطِ (عِصْمَةُ مَقْتُولٍ، وَلَوْ) كَانَ (مُسْتَحَقًّا دَمُهُ بِقَتْلٍ لِغَيْرِ قَاتِلِهِ) ؛ لِأَنَّهُ لَا سَبَبَ فِيهِ يُبِيحُ دَمَهُ لِغَيْرِ مُسْتَحِقِّهِ
