(وَلَا يَمْلِكُ اسْتِيفَاءَهُ) أَيْ: الْقِصَاصِ (لَهُمَا) أَيْ: الصَّغِيرِ وَالْمَجْنُونِ (أَبٌ كَوَصِيٍّ وَحَاكِمٍ) إذْ لَا يَحْصُلُ بِاسْتِيفَائِهِمْ التَّشَفِّي لِلْمُسْتَحِقِّ لَهُ، فَتَفُوتُ حِكْمَةُ الْقِصَاصِ
