(وَمَنْ مَاتَ) مِنْ وَرَثَةِ مَقْتُولٍ (فَوَارِثُهُ) أَيْ: الْمَيِّتِ (كَهُوَ) لِقِيَامِهِ مَقَامَهُ؛ لِأَنَّهُ حَقٌّ لِلْمَيِّتِ فَانْتَقَلَ إلَى وَارِثِهِ كَسَائِرِ حُقُوقِهِ
