(وَإِنْ اخْتَارَهَا) ابْتِدَاءً (تَعَيَّنَتْ) وَسَقَطَ الْقَوَدُ.

قَالَ أَحْمَدُ: إذَا أَخَذَ الدِّيَةَ فَقَدْ عَفَا عَنْ الدَّمِ (فَلَوْ قَتَلَهُ) وَلِيُّ الْجِنَايَةِ (بَعْدَ) اخْتِيَارِ الدِّيَةِ (قُتِلَ بِهِ) لِأَنَّ حَقَّهُ سَقَطَ مِنْ الْقِصَاصِ بِعَفْوِهِ عَنْهُ
