وَإِنْ وَجَبَ لِقِنٍّ قَوَدٌ أَوْ تَعْزِيرُ قَذفٍ فَلَهُ طَلَبُهُ وَإسْقَاطُهُ فَإِن مَاتَ فَلِسَيِّدِهِ.

(وَإِنْ وَجَبَ لِقِنٍّ قَوَدٌ أَوْ) وَجَبَ لَهُ (تَعْزِيرُ قَذْفٍ) وَنَحْوُهُ (فَلَهُ) ؛ أَيْ: الْقِنِّ (طَلَبُهُ وَلَهُ إسْقَاطُهُ) ؛ لِاخْتِصَاصِهِ بِهِ دُونَ سَيِّدِهِ؛ لِأَنَّهُ لَا يَسْتَحِقُّهُ مَا دَامَ الْقِنُّ حَيًّا، وَلَيْسَ لَهُ إسْقَاطُ الْمَالِ (فَإِنْ مَاتَ) الْقِنُّ (فَلِسَيِّدِهِ) طَلَبُهُ وَإِسْقَاطُهُ كَالْوَارِثِ؛ لِأَنَّهُ أَحَقُّ مِمَّنْ لَيْسَ لَهُ فِيهِ مِلْكٌ.
