وَمِنْ قُطِعَتْ يَدُهُ مِنْ مِرْفَقٍ فَأَرَادَ انقَطعَ مِنْ كُوعٍ مُنِعَ.

(وَمِنْ قُطِعَتْ يَدُهُ مِنْ مِرْفَقٍ فَأَرَادَ الْقَطْعَ مِنْ كُوعِ) يَدِ جَانٍ (مُنِعَ) ؛ لِأَنَّهُ يُمْكِنُ الِاسْتِيفَاءُ مِنْ مَحَلِّ الْجِنَايَةِ؛ فَلَا يَقْتَصُّ مِنْ غَيْرِهِ؛ لِاعْتِبَارِ الْمُسَاوَاةِ فِي الْمَحَلِّ حَيْثُ لَا مَانِعَ.
