(وَيَتَّجِهُ الْأَصَحُّ) أَنَّهُ يَلْزَمُهَا الْحَدُّ إنْ كَانَ الْمُمَيِّزُ وَالْمَجْنُونُ (يَطَأُ مِثْلُهُ كَعَكْسِهِ) ؛ أَيْ: كَمَا لَوْ وَطِئَ صَغِيرَةً أَوْ مَجْنُونَةً يُوطَأُ مِثْلُهَا (وَأَوْلَى) كَمَا تَقَدَّمَ، وَهُوَ مُتَّجِهٌ
