(حُجَّةٌ) فِيهَا (وَظِيفَةٌ) لِغَيْرِهِ؛ فَتَعَذَّرَ اسْتِيفَاءُ الْوَظِيفَةِ بِدُونِ إحْضَارِ الْحُجَّةِ؛ فَيَضْمَنُهَا مُتْلِفُهَا؛ لِتَعَدِّيهِ،
