(وَيَتَّجِهُ) أَنَّهُ لَا يُقْطَعُ الْمَسْرُوقُ مِنْهُ بِسَرِقَتِهِ مِنْ مَالِ سَارِقٍ أَوْ غَاصِبٍ مِنْ حِرْزٍ غَيْرِ الَّذِي بِهِ الْمَالُ الْمَسْرُوقُ أَوْ الْمَغْصُوبُ [ (عَلَى تَوَهُّمٍ أَنَّهُ) ؛ أَيْ: الْمَالَ الْمَسْرُوقَ أَوْ الْمَغْصُوبَ فِيهِ] لِلشُّبْهَةِ، وَهُوَ مُتَّجِهٌ
