(وَمَنْ أُسِرَ مِنْهُمْ) ؛ أَيْ: الْبُغَاةِ (وَلَوْ صَبِيًّا أَوْ أُنْثَى حُبِسَ حَتَّى لَا شَوْكَةَ وَلَا حَرْبَ) دَفْعًا لِضَرَرِهِمْ عَنْ أَهْلِ الْعَدْلِ؛ لِأَنَّهُ رُبَّمَا تَحْصُلُ مِنْهُ مُسَاعَدَةُ الْمُقَاتِلَةِ،
