مطالب أولي النهىal-Ruhaybani

(وَإِنْ اسْتَعَانُوا) ؛ أَيْ: الْبُغَاةُ (بِأَهْلِ حَرْبٍ وَأَمَّنُوهُمْ ف) أَمَانُهُمْ (كَعَدَمِهِ) ؛ لِأَنَّهُمْ عَقَدُوهُ عَلَى قِتَالِنَا وَهُوَ مُحَرَّمٌ؛ فَلَا يَكُونُ سَبَبًا لِعِصْمَتِهِمْ، فَيُبَاحُ قَتْلُهُمْ مُقْبِلِينَ وَمُدْبِرِينَ، وَأَخْذُ أَمْوَالِهِمْ، وَسَبْيُ ذَرَارِيِّهِمْ
