وَإن عَيَّنَ مَسجِدًا فِي غَيرِ حَرَمٍ لَم يَلزَمْهُ إتيَانُهُ

(وَإِنْ عَيَّنَ) بِنَذْرِهِ أَنْ يَأْتِيَ (مَسْجِدًا فِي غَيْرِ حَرَمٍ) ؛ أَيْ: غَيْرِ الْمَسَاجِدِ الثَّلَاثَةِ (لَمْ يَلْزَمْهُ إتْيَانُهُ) فَيُخَيَّرُ بَيْنَ فِعْلِهِ وَالتَّكْفِيرِ؛ لِحَدِيثِ «لَا تُشَدُّ الرِّحَالُ إلَّا إلَى ثَلَاثَةِ مَسَاجِدَ: الْمَسْجِدِ الْحَرَامِ وَمَسْجِدِي هَذَا وَالْمَسْجِدِ الْأَقْصَى»
