(وَلَا) تُفِيدُ وِلَايَةُ حُكْمٍ (الِاحْتِبَاسَ عَلَى الْبَاعَةِ وَالْمُشْتَرِينَ وَلَا إلْزَامَهُمْ بِالشَّرْعِ) لِأَنَّ الْعَادَةَ لَمْ تَجْرِ بِتَوَلِّي الْقَضَاءِ لِذَلِكَ.
