وَلا إِنْ ادَّعَى اسْتِدَامَةَ الزَّوْجِيَّةِ فَقَطْ

(وَإِنْ ادَّعَى اسْتِدَامَةَ الزَّوْجِيَّةِ فَقَطْ) ؛ أَيْ: وَلَمْ يَدَّعِ الْعَقْدَ (لَمْ يَحْتَجْ لِذِكْرِ شُرُوطِ الْعَقْدِ) لِأَنَّهُ يَثْبُتُ بِالِاسْتِعَاضَةِ الَّتِي لَا يُعْلَمُ مَعَهَا اجْتِمَاعُ الشُّرُوطِ.
