(فَإِنْ لَمْ يَحْلِفْ قَضَى عَلَيْهِ) بِالنُّكُولِ (بِسُؤَالِ مُدَّعٍ) ذَلِكَ؛ لِأَنَّ عُثْمَانَ قَضَى عَلَى ابْنِ عُمَرَ بِنُكُولِهِ. رَوَاهُ أَحْمَدُ ، وَلِقَوْلِهِ - عَلَيْهِ الصَّلَاةُ وَالسَّلَامُ -: «الْيَمِينُ عَلَى الْمُدَّعَى عَلَيْهِ» فَحَصَرَهَا فِي جِهَتِهِ؛ فَلَمْ تُشْرَعْ لِغَيْرِهِ
