ويجِبُ امتِنَاعُها مِنْهُ فَإِنْ أَكْرَهها فَهُوَ الآثِمُ وَيَصِحُّ نِكَاحُها غَيرَهُ

(وَيَجِبُ امْتِنَاعُهَا مِنْهُ) مَا أَمْكَنَهَا (فَإِنْ أَكْرَهَهَا وَوَطِئَهَا فَهُوَ الْآثِمُ) لَا هِيَ؛ لِأَنَّهَا مُكْرَهَةٌ (وَيَصِحُّ نِكَاحُهَا) ؛ أَيْ: الْمَرْأَةِ الْمَحْكُومِ بِنِكَاحِهَا لِرَجُلٍ بِبَيِّنَةٍ زُورٍ (غَيْرَهُ) لِخُلُوِّهَا مِنْ النِّكَاحِ.
