(وَإِنْ مَاتَ الْقَاضِي الْكَاتِبُ أَوْ عُزِلَ لَمْ يَضُرَّ) ؛ أَيْ: لَمْ يَمْنَعْ ذَلِكَ قَبُولَ كِتَابِهِ وَالْعَمَلَ بِهِ (ك) مَوْتِ (بَيِّنَةٍ أَصْلٍ) فَيُحْكَمُ بِشُهُودِ الْفَرْعِ.
