(وَلِمَنْ خَرَجَ فِي نَصِيبِهِ) مِنْ الشُّرَكَاءِ (عَيْبٌ جَهِلَهُ) وَقْتَ الْقِسْمَةِ (إمْسَاكُ) نَصِيبِهِ الْمَعِيبِ (مَعَ أَخْذِ أَرْشِ) الْعَيْبِ مِنْ شَرِيكِهِ (كَفَسْخٍ) ، أَيْ: كَمَا لَهُ فَسْخُ الْقِسْمَةِ كَالْمُشْتَرِي، بِوُجُودِ النَّقْصِ.
