(وَيُسَنُّ الْإِشْهَادُ فِي كُلِّ عَقْدٍ سَوَاءٌ) مِنْ بَيْعٍ وَإِجَارَةِ صُلْحٍ وَغَيْرِهِ، وَلِقَوْلِهِ:{وَأَشْهِدُوا إِذَا تَبَايَعْتُمْ} وَحُمِلَ عَلَى الِاسْتِحْبَابِ؛ لِقَوْلِهِ تَعَالَى:{فَإِنْ أَمِنَ بَعْضُكُمْ بَعْضًا فَلْيُؤَدِّ الَّذِي اؤْتُمِنَ أَمَانَتَهُ} .
