وَفِي سَرِقَةٍ ذِكْرُ مَسْرُوقٍ مِنْهُ وَنِصَابٍ وَحِرْزٍ وَصِفَتِهَا

(وَ) يُعْتَبَرُ فِي شَهَادَةٍ (بِسَرِقَةٍ ذِكْرُ مَسْرُوقٍ مِنْهُ وَذِكْرُ نِصَابٍ وَصِفَتِهَا) أَيْ: السَّرِقَةِ كَقَوْلِهِ خَلَعَ الْبَابَ لَيْلًا، وَأَخَذَ الْفَرَسَ، وَأَزَالَ رَأْسَهُ عَنْ رِدَائِهِ وَهُوَ نَائِمٌ بِمَحَلِّ كَذَا.
وَأَخَذَهُ وَنَحْوَهُ؛ لِاخْتِلَافِ الْحُكْمِ بِاخْتِلَافِ السَّرِقَةِ.
