(وَ) يُعْتَبَرُ فِي شَهَادَةٍ بِإِكْرَاهٍ عَلَى فِعْلٍ أَوْ قَوْلٍ يُؤَاخَذُ بِهِ لَوْ كَانَ طَائِعًا، ذِكْرُ (أَنَّهُ ضَرَبَهُ أَوْ هَدَّدَهُ) عَلَيْهِ (وَهُوَ قَادِرٌ عَلَى وُقُوعِ الْفِعْلِ) الَّذِي هَدَّدَهُ (بِهِ) .
